Terms of Service

1. Acceptance of Terms

These Terms of Service (“Terms”) constitute a legally binding agreement between you and ClearSkies Travel Line LLC (“we,” “us,” “our,” or the “Agency”). By accessing our website, calling our dedicated booking line at (855) 220-8250, or purchasing travel services through us, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

If you do not agree with any part of these Terms, you must not use our services or provide payment information to our agents.

2. Agency Status Disclosure

ClearSkies Travel Line LLC is an independent, third-party travel booking agency and is not directly affiliated with, sponsored by, or endorsed by any specific airline, hotel chain, or carrier.

We do not own, operate, or control any airlines, aircraft, hotels, car rental companies, cruise lines, tour operators, or other travel suppliers. We act solely as a third-party broker and booking agent that facilitates reservations between you and independent travel suppliers.

All bookings are subject to the ultimate terms, conditions, fare rules, policies, and contractual agreements of the respective airline, hotel, or travel supplier. By confirming a booking with us, you agree to comply with those supplier terms in addition to these Terms. Supplier terms may include, but are not limited to, baggage policies, check-in requirements, cancellation rules, change fees, and conditions of carriage.

3. User Eligibility and Phone Bookings

By calling our booking line and completing a reservation, you represent and warrant that:

  • You are at least 18 years of age and have the legal capacity to enter into a contract.
  • You are the authorized cardholder for any credit card, debit card, or payment method used, or you have obtained express authorization from the cardholder to charge that payment method.
  • All information you provide to us, including passenger names, dates of birth, contact information, billing addresses, and travel document details, is accurate, complete, and truthful.
  • You understand that airline tickets and many hotel reservations are issued in the exact names provided, and errors may result in denied boarding, cancellation, or additional fees.

We reserve the right to refuse service, cancel a booking, or request additional verification if we believe any information is inaccurate, fraudulent, or unauthorized.

4. Pricing and Availability

Flight fares, hotel rates, and other travel inventory fluctuate constantly and are not guaranteed until your payment has been successfully processed and a confirmed ticket, voucher, or reservation has been officially issued to you by email.

Any price quoted by our agents over the phone is based on real-time availability at the moment of the quote. A quote does not create a binding reservation. Prices may change before payment is completed due to supplier rate adjustments, seat or room inventory changes, or currency fluctuations.

The final total quoted to you before payment will include the supplier cost, applicable taxes, carrier-imposed fees, hotel resort fees (where known), and any Agency service fees. You authorize the full quoted amount when you provide payment information and confirm the booking verbally or otherwise.

5. Agency Service Fees

ClearSkies Travel Line LLC may charge a non-refundable service, booking, or administrative fee for the time, expertise, and resources used to research, quote, reserve, and confirm your travel arrangements over the phone. This fee is separate from the amount charged by the airline, hotel, or other supplier.

Any Agency service fee will be clearly disclosed to you verbally before you authorize payment, and it will be included in the final total quoted. By approving the charge, you agree that the Agency fee is earned at the time the booking is completed and is non-refundable under all circumstances, including cancellations, supplier refunds, unused tickets, or changes.

6. Payment Authorization

When you provide credit card, debit card, or other payment information to our agents over the phone, you expressly authorize us and our payment processors to charge the full quoted amount for the travel services requested, including any applicable taxes and fees.

You are responsible for ensuring that your payment method has sufficient funds or available credit. If a charge is declined, reversed, or disputed, we may cancel your reservation and charge any applicable cancellation or penalty fees permitted by the supplier and these Terms.

7. Cancellations, Changes, and Refunds

All cancellations, changes, and refund requests are governed by the supplier's policies and our Refund and Cancellation Policy, which is incorporated by reference into these Terms.

To request a cancellation or change, you must call us at (855) 220-8250. We do not accept cancellation or change requests by email, text, or social media. Most changes and cancellations are subject to supplier penalties, fare differences, and non-refundable Agency fees.

8. Traveler Responsibilities

You are solely responsible for ensuring that you and all travelers on your booking:

  • Hold valid passports, visas, travel authorizations, and any other documents required for travel.
  • Comply with immigration, customs, health, and security requirements of the departure, destination, and transit countries.
  • Arrive at the airport, hotel, or other departure point with sufficient time to complete check-in, security, and boarding procedures.
  • Review and understand the supplier's terms, including baggage allowances, fare rules, and change restrictions.

ClearSkies Travel Line LLC is not responsible for travel disruptions caused by incorrect, incomplete, or expired travel documents.

9. Limitation of Liability

To the fullest extent permitted by applicable law, ClearSkies Travel Line LLC and its owners, employees, agents, and affiliates shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of our services or any travel booking.

Specifically, we are not liable for:

  • Flight delays, cancellations, diversions, or schedule changes.
  • Denied boarding, overbookings, or missed connections.
  • Lost, delayed, or damaged baggage or personal belongings.
  • Hotel overbookings, room unavailability, property defects, or disputes with accommodation providers.
  • Acts of God, Force Majeure, or events beyond our reasonable control, including but not limited to severe weather, natural disasters, strikes, war, terrorism, pandemics, government restrictions, or supplier bankruptcies.
  • Any damages resulting from inaccurate information provided by you or a third party.

Our total liability to you for any claim arising from a booking shall not exceed the total Agency service fees actually paid by you for that booking.

10. Indemnification

You agree to indemnify, defend, and hold harmless ClearSkies Travel Line LLC and its owners, employees, agents, and affiliates from and against any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising out of your use of our services, your breach of these Terms, or your violation of any supplier terms or applicable law.

11. Intellectual Property

All content on our website, including text, graphics, logos, images, and software, is the property of ClearSkies Travel Line LLC or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without our prior written consent.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles.

Any dispute, claim, or controversy arising out of or relating to these Terms or our services shall be resolved exclusively in the state or federal courts located in New Castle County, Delaware. You consent to the personal jurisdiction and venue of such courts.

13. Severability and Entire Agreement

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. These Terms, together with our Privacy Policy and Refund and Cancellation Policy, constitute the entire agreement between you and ClearSkies Travel Line LLC regarding the subject matter hereof.

14. Changes to These Terms

We may update these Terms at any time. The version in effect at the time of your booking applies to that booking. We encourage you to review these Terms periodically. Continued use of our services after changes constitutes acceptance of the revised Terms.
